Terms and Conditions

1. Services

Cloud Peak Solutions offers the following services:

• Web design and development
• Local SEO
• Google Business Profile management
• Social media management (organic content for Instagram and Facebook)
• Website maintenance and hosting

2. Free build offer

Cloud Peak Solutions builds your website at no upfront cost. You review the completed website and pay the one-time setup fee only if you are satisfied with the result. If you are not satisfied, the site is deleted and you owe nothing.

3. Website ownership and licence

Cloud Peak Solutions retains full ownership of all websites we build. Clients receive a licence to use the website for their business while their subscription remains active and in good standing. Ownership is not transferred by payment of the setup fee or any monthly fee.

4. Cancellation and what happens to the site

Any monthly service may be cancelled with 30 days' written notice. On cancellation, the website licence is revoked and the site is unpublished. The website is not transferred to the client unless ownership has been explicitly transferred in writing.

5. Payment terms

• The one-time setup fee is due upon your approval of the completed website.
• Monthly maintenance and hosting fees are due monthly, in advance, for each billing period.
• All prices are quoted in Canadian dollars unless stated otherwise.

6. Failed payments

If a payment fails, there is a 7-day grace period during which service continues while you update your payment details. If payment is not received within that period, service may be suspended and the site may be unpublished until the account is brought current.

7. Refund policy

Once the one-time setup fee has been paid and the site has been launched, refunds are not available, as the service has been delivered. Monthly maintenance and hosting fees are non-refundable for the current billing period; you may cancel with 30 days' written notice to stop future charges.

8. Client responsibilities

• Providing content, images and information needed to build and maintain the site
• Confirming that any content you supply is accurate and that you hold the rights to use it
• Keeping your billing details current

9. Limitation of liability

To the maximum extent permitted by law, Cloud Peak Solutions is not liable for any loss of business, revenue, profits, goodwill or data arising from the use of, or inability to use, any website or service we provide. Our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim.

10. Intellectual property

All website designs, code, and content created by Cloud Peak Solutions remain the property of Cloud Peak Solutions unless explicitly transferred in writing. Content you supply remains yours, and you grant us the licence needed to use it in delivering your service.

11. Governing law and disputes

These terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada. Any dispute arising from these terms or our services is subject to the exclusive jurisdiction of the courts of British Columbia.

12. Changes to these terms

We may update these terms from time to time. The “last updated” date at the top of this page always reflects the current version.
